These Terms of Service (“Terms”) are part of the User Agreement – a legally binding contract governing your use of Phly. You should read these Terms of Service (“Terms”) in full, but here are a few key things you should take away:
- Eligibility: You must be at least 13 years old to use
Phly. Government officials are not allowed to create accounts or
participate on the platform.
- Prohibited Conduct: Users may not engage in unlawful,
harassing, or harmful activities, spread misinformation, impersonate others,
or share personal/private information without consent.
- Political Discussions: Allowed only during election
years and will be heavily moderated to ensure respectful and factual
discourse.
- Sexual Content: Permitted if users include an "18+"
disclaimer in their bio. However, nudity is strictly prohibited in profile
or cover images.
- Account Termination: We reserve the right to suspend or
remove accounts that violate our rules, with or without notice.
- Content Ownership: Users retain ownership of their
content but grant Phly a non-exclusive license to display and distribute it.
- Platform Modifications: We may update, suspend, or
discontinue features at any time.
- Liability Disclaimer: Phly is provided "as is," and we are not responsible for any damages resulting from its use.

Welcome to Phly, a social media platform designed to foster free expression, creativity, and community engagement. By accessing or using Phly, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any of these terms, you must discontinue use of the platform immediately.
1. Acceptance of Terms
By registering for or using Phly, you agree to abide by these Terms and our
Privacy Policy. These Terms apply to all users of the platform.
2. Eligibility
Phly is available to individuals who are at least 13 years old. By using the
platform, you represent and warrant that you meet this eligibility requirement.
We do not permit government officials to create accounts or use the platform,
and we reserve the right to deny access to such individuals as a private company
under the protections of the First Amendment.
3. Prohibited Conduct
You agree not to use Phly to:
- Engage in unlawful, harmful, or fraudulent activities.
- Harass, threaten, or intimidate other users.
- Distribute spam, malware, or unauthorized advertisements.
- Impersonate any person or entity, including Phly staff.
- Post or share content that is defamatory, obscene, or incites violence.
- Attempt to circumvent any security features of the platform.
- Post content that infringes on the intellectual property rights of others.
- Share private or personal information of others without consent.
- Create multiple accounts to evade bans or restrictions.
- Use automated tools or bots to interact with the platform.
- Engage in any form of hate speech, discrimination, or extremism.
- Spread false or misleading information intentionally.
- Promote self-harm, suicide, or dangerous activities.
- Exploit minors in any form.
- Engage in doxxing or cyber bullying.
- Sell, trade, or transfer your account to another individual.
- Attempt to manipulate engagement metrics, such as likes or follows.
- Use Phly for commercial solicitation without authorization.
- Attempt to hack, disrupt, or compromise the platform’s integrity.
- Participate in mass-reporting or coordinated harassment campaigns.
4. Government Officials
As a private company, Phly exercises its First Amendment rights to curate its
community. Government officials—whether local, state, or federal—are not
permitted to create accounts or participate on Phly in any capacity. If we
determine that an account is operated by a government official, we reserve the
right to terminate access immediately without notice or explanation.
5. Political Discussions During Election Years
During election years, Phly will allow political discussions. However, such
discussions will be heavily moderated to prevent misinformation, harassment, and
inappropriate content. Moderators will have the authority to remove posts,
restrict discussions, and enforce rules to ensure a respectful and factual
discourse.
6. Sexual Content Policy
Phly allows users to post sexual content; however, such users must include an
"18+" disclaimer in their bio. Additionally, under no circumstances may users
upload nudity as their profile photo or cover image. Failure to adhere to this
policy may result in account suspension or termination.
7. Content Ownership and License
Users retain ownership of their content. However, by posting content on Phly,
you grant us a non-exclusive, royalty-free, worldwide license to use, display,
and distribute your content in connection with platform operations. You affirm
that you have the necessary rights to grant this license.
8. Account Termination
We reserve the right to suspend or terminate accounts at our discretion, with
or without notice, for any violation of these Terms. If your account is
terminated, you may not re-register without explicit permission from Phly.
9. Modifications to the Platform
Phly may modify, suspend, or discontinue any aspect of the platform at any
time. We are not liable for any loss resulting from such changes.
10. Disclaimers and Limitation of Liability
Phly is provided "as is" without warranties of any kind. We disclaim
liability for any direct, indirect, incidental, or consequential damages arising
from your use of the platform. Your use of Phly is at your own risk.
11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes
arising from these Terms shall be resolved in the courts of California.
12. Changes to These Terms
We may update these Terms at our discretion. Continued use of the platform after changes constitute acceptance of the updated Terms.
